  Gates County, NC Estates Records Stack File #C.R.041.508.1 North Carolina--Court of Pleas & Quarter Sessions Gates County November Term 1849 To the worshipful, the Justices of the Court of Pleas and Quarter Sessions of the County aforesaid. The petition of Benj: BROWN, Timothy SPIVEY and Nancy his wife--of William BROWN and Robert PARKER in right of his wife Louisa children of Jesse BROWN-deceased-of Nathan PARKER & Levy CRANK-in right of his wife Martha /Lear EURE and John CLEAVES/ children of Lavinia PARKER deceased and of Henry HOFLER. Your petitioners shew your worships that they are seized of a certain tract or parcel of /marsh/ land lying & being in the County of Gates aforesaid containing about 280 acres bounded by the lands of Benj: BROWN, the lands belonging to the heirs at law of Henry BOND--the lands belonging to Timothy /WALTON/ and Jethro BLANSHARD as tenants in common with the heirs at law of Sarah WILLIAMS deceased. Your petitioners shew your worships that the said tract tract [sic] of land descended to them from Samuel BROWN deceased, the ancestor of all except the petitioner Henry HOFLER, who represents the interest of Miles BROWN deceased /in said land/ who was a son of the said Samuel-by purchase. Your petitioners further shew, that Sarah WILLIAMS who was a daughter of the said Samuel BROWN, and the wife of one Mills WILLIAMS moved many years ago to the State of Georgia, and they are both reputed to be dead leaving /Nine/ children-viz: - Benjamin, Jordan, Allen, Robert, Betsey, Sophia, Nancy, Louisa & Martha, some of whom are married but to whom /and whether \your petitioners? not know\ [crossed out] they, or any of them are dead your petitioners can not know/ Your petitioners shew your worships that they are desirous of having the said land divided, so that each /original share/ may /be/ held \his or her part\ in severalty?, and to this end they pray your worships to appoint competent commissioners to divide the same between as fairly & equitably as they can-giving to the petitioner Benj: BROWN one sixth part of the said land-To Timothy SPIVEY & Nancy his wife one sixth part of the same; to William BROWN one twelth [sic] part of the same; to Robert PARKER & Louisa his wife one [word interlined & crossed out-illegible.] twelth part of the same; to Nathan PARKER one \twelth\ [word interlined & crossed out- illegible.] part of the same; to Levi CRANK & Martha his wife one \twelth\ /twenty fourth/ part of the same; to Lear EURE one twenty fourth part of the same-to John CLEAVES to one twenty-fourth part to the heirs at law of Sarah WILLIAMS decd one sixth part of the same; and to Henry HOFLER one sixth part of the same. And May it please your worships to order publication to be made for the said Benjamin, Jordan, Allen, Robert, Betsy, Sophia, Nancy, Louisa, & Martha WILLIAMS-and all and every other person claiming any interest in the said land under or through the said Sarah WILLIAMS to be and appear &c.
