  Gates County, NC Estates Records Stack File #C.R.041.508.18 North Carolina Court of Pleas & Quarter Sessions Gates County May Term 1848 To the Worshipful the Justices of the said Court the petition of David PARKER, the administrator of Miles BROWN shewes your worships, that he ___ ____into possession all? the personal assets of his intestate of which he has any knowledge, and that the sum was insufficient to pay the debts of his intestate. That the debts which he has ascertained amount to about five hundred and twenty dollars, including a debt for which the said Miles became bound in the Security? of his Sun? in a note payable to John WALTUN [sic] for about $85. That he has paid out personal assets to the amount of about $300 leaving about $200 [$210?] besides the expenses of settling said estate, which your petitioner thinks will amount to $40 or $50 to be paid out of the net? estate. Your petitioner shewes your worships that administration upon said estate was committed to him at the Novr. Term 1847 of said Court. He further shews your worships that the said Miles at the time of his death was seized in fee simple of an undivided sixth part of a certain tract or parcel of land lying and being in Gates County, held in common with Benjamin BROWN Timothy SPIVEY & wife, Jesse BROWNs heirs, Lavinia PARKERs heirs & the heirs of Sarah WILLIAMS, containing about 280 acres not remaining in ___ ___ ___ he believes all of which is marsh land, and will sell for very little and adjoins the lands of Benjamin BROWN, the lands belonging to the heirs of Henry BOND, and the lands belonging to Timothy WALTON and Jethro BLANCHARD. That the said Miles at the time of his death was also seized of another tract or parcel of land upon which he lived adjoining the lands of J. BLANCHARD, David BROWN, Timothy WALTON, Samuel BROWN & Benj. BROWN Senr. containing one hundred & thirty acres more or less, upon which the widow of said Miles has dower. Your petitioner further shewes your worships that the said Miles at the time of his death left the following heirs at law, to wit, Allen BROWN, who lives in the State of Texas, Nancy BLANCHARD, a daughter of said Miles, Sally BROWN, Samuel BROWN, Benjamin BROWN, David BROWN, Easton BRISCO & wife Mary, who is a daughter of said Miles & Ellen BROWN an infant under the age of twenty one years. Your petitioner Shewes your worships that it will Require the whole or the greater part of the proceeds of the sales of said lands to pay the residue of the debts of his intestate and the expenses of settling the \same\ [crossed out] estate. That the proceeds of the sale of the undivided interest of the said Miles in the tract first mentioned he has reason to believe will be entirely insufficient to pay the Same. And he Shewes your worships that if it does not require the whole amount of the Sales of the tract upon which the said Miles lived to pay the reidue of the debts of said estate, and the expenses of settling the Same, that a sale of a sufficiency of said land for that purpose would leave a very small residue of the tract that would be nearly, if not quite valueless to the heirs of said Miles. Your petitioner therefore prays your worships for an ___ ___ giving him license to sell the entire estate of the said Miles in the two tracts of land above described. And that your worships will make such other & further order & decree in the premises in ___ your worships may seem right. And may it please your worships to order notice of this petition to be served upon the said Nancy BLANCHARD, Sally BROWN, Samuel BROWN, Benjamin BROWN, Eastern BRISCOE [sic] & wife & Ellen BROWN & advertisement to be made for the Said Allen BROWN to ___.
