  Gates County, NC Estates Records Stack File #C.R.041.508.17 State of North Carolina } County of Gates} Court of Pleas &c November Term 1854 To the Worshipful the Justices of said Court The petition of Nancy BROWN Widow of Benjamin BROWN, respectfully showeth to your Worships, that her said husband died intestate in Gates County since the last term of this Court, leaving him surviving the following children to wit Daniel BROWN Hardy BROWN Noah BROWN Sarah Ann intermarried with George STEPHENS, and Sophia intermarried with Josiah BLANCHARD who are his only heirs at law. Your petitioner further showeth, that her said husband at the time of his death was seized in fee simple, of a tract of land situated in said County, on which the said Benjamin BROWN resided at the time of his death adjoining the lands of Isaac HYATT, William BROWN, Easton BLANCHARD and others, containing about 120 acres more or less. Your petitioner further showeth that she desires to have her dower in the said land allotted to her, and to that end she prays your worships to order a writ to be issued to the Sheriff commanding him to summon Twelve free holders connected with the parties neither by consanguinity or affinity and entirely disinterested, to view the aforesaid tract of land, and to allot and set apart to her, one third part thereof including the dwelling house and all out houses, buildings and improvements appertaining to the same, for the term of her natural life, and to report their proceedings in due form of law. May it please your Worships to order subpeonas with copies of this petition to be issued to the said Daniel BROWN, Hardy BROWN, Noah BROWN, Sarah Ann STEPHENS and Sophia BLANCHARD, requiring them to appear at the next term of this Court and show cause if any they can, why the prayer of your petitioner shall not be granted.
